BOOKING CONDITIONS AND LIABILITY RELEASE

DEFINITIONS

Client - company, agency or person(s) who completes the Booking with our Online Booking system referred to in our Forms as Contact Name.

Kangaroo Island Diving Safaris Pty Ltd - referred to as "KIDS".

Micronesia Eco Diving Adventures Inc. - referred to as "MEDA".

1. RESERVATIONS

20% of trip fee will hold reservation until 60 days prior to the expedition when the balance is to be paid.

2. CANCELLATIONS NOTIFIED

• More than 90 days prior to departure; forfeit $100
• Less than 90 days, forfeit 30% of trip fee
• Less than 60 days, forfeit 50% of trip fee
• Less than 30 days, forfeit 100% of trip fee

3. PURCHASE TRAVEL INSURANCE OR ACCEPT FINANCIAL RISK

The client understands unforseen work, medical or airline problems may cause the client to cancel a trip. Compensation for trip cancellation due to any reason must be claimed against the clients travel insurance. Weather problems may cause the trip to be cancelled/delayed or shortened.

No compensation is offered in any situation to changed flights or holiday plans. No refund is offered for time lost due to the medical evacuation of a passenger or reduction of dives due to bad weather. In event of cancellation of trip due to bad weather KIDS will attempt to arrange alternative activities for clients.

4. EQUIPMENT AGREEMENT

The client agrees to reimburse Kangaroo Island Diving Safaris Pty Ltd for any of their diving equipment lost or damaged whilst in the clients care.

5. MEDICAL STATEMENT

The client states that they are in good health for diving. The client has no medical history of heart or lung disorders, asthma or epilepsy, neither as an insulin dependent diabetic. The client will not dive on an expedition if the client is feeling unwell or has a chest cold or respiratory congestion on the expedition. The client understands if there are any medical condition contrary to these requirements the client must produce a diving medical certificate completed by a diving medical specialist. "KIDS" and/or "MEDA" are authorised to make medical and transport arrangements as may be determined in my best interest. I agree to pay expenses incurred on my behalf which may be charged against my credit card. I will bring proof of my diver medivac insurance or purchase it on arrival.

DAN 30-day Travel Assist - Evacuation cover of $16 available on arrival.

(This covers evacuation not treatment).

DISCHARGE OF LIABILITY

It is a fundamental condition of this contract between "KIDS" and its employees and agents and/or "MEDA" and its employees and agents on the one part and the client on the other part, that to the extent permitted by law "KIDS" and/or "MEDA" is hereby discharged by the clients executor(s), administrator(s) and dependent(s) from any liability for any damage, death or injury whatsoever arising out of or incidental to this diving expedition, rafting and other services provided by "KIDS" and/or "MEDA" whether or not such damage or personal injury is caused or contributed to by "KIDS" or "MEDA".

The client further acknowledges awareness of the risks of injury associated with participation in this diving expedition and voluntarily agrees to assume such risk of injury.

STATEMENT OF UNDERSTANDING

By inserting the clients name on the Booking Form the client acknowledges that the 'BOOKING CONDITIONS AND LIABILITY RELEASE' have been read, understood and accepted.
